Challenging bench composition: failure to substantiate the timeline of juror excusal and backup summons under § 338 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the revisions of the defendants as unfounded, upholding the judgment of the Regional Court of Hamburg. The case involved a robbery proceeding where the defendants challenged the legality of the bench composition, specifically the appointment of a backup juror after the primary juror and the next available backup were prevented from attending due to short-notice summons and professional absence; the court held that the challenge failed because the defendants did not provide a comprehensive legal justification as required by § 338 No. 1 and § 222b StPO, and did not specify the chronological sequence of the jurors' excusals, making it impossible for the court to review whether the presiding judge applied the correct standard for excusing the backup juror. Additionally, the court found that the defendants suffered no substantive legal prejudice from the lower court's refusal to classify the offense as particularly aggravated robbery under § 250 (2) No. 3 letter a StGB, despite the victim's severe injuries. Consequently, the defendants bear the costs of their appeals and the necessary expenses of the auxiliary plaintiff.

Barthe in KK-StPO, 7. Aufl., GVG, § 54 Rn. 7).
