Discrepancy between operative judgment and reasoning in criminal sentencing: mandatory correction to align total custodial sentence with calculated amount
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Revision (BGH) partially granted the defendant's appeal, modifying the sentence in the operative part of the judgment to a total custodial sentence of one year and three months with probation, while dismissing the remainder of the appeal and upholding the defendant's liability for costs. The dispute arose from a discrepancy between the lower court's operative judgment, which imposed a total sentence of one year and four months, and its reasoning, which calculated the total at one year and three months for nine counts of fraud. Relying on the principle of correcting errors between the judgment's operative part and its reasoning, and citing § 473 Abs. 4 StPO regarding cost allocation for minor successes, the BGH aligned the operative sentence with the lower court's actual legal calculation, thereby establishing that the revised one-year-and-three-month sentence prevails.
