Sentencing framework selection: no obligation to apply the most lenient statutory range when multiple mitigating grounds coincide
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) 5th Criminal Senate rejected the defendant’s revision as unfounded, thereby upholding the lower court’s conviction and sentencing. The dispute concerned whether the trial court committed an error in sentencing by selecting a specific statutory sentencing framework instead of the most lenient option available when multiple mitigating grounds coincided. The Court held that while a trial court must assess in a comprehensive overall evaluation whether to apply the mitigated standard sentencing framework under § 49 StGB or the framework for lesser offenses, it is not legally obligated to select the framework most favorable to the defendant. The decision affirmed that the choice between applicable sentencing frameworks remains a matter of the court’s lawful discretion, and the principle of *in dubio pro reo* (rule of doubt in favor of the accused) does not apply to this discretionary choice regarding the selection of the sentencing range.

[TENOR]
BGH, Urteile vom 3. Mai 1966 - 5 StR 173/66, BGHSt 21, 57, 59; vom 19. Januar 1982 - 1 StR 734/81, NStZ 1982, 200; Lackner/Kühl, StGB, 28. Aufl., § 50 Rn. 2; Schäfer/Sander/van Gemmeren, Praxis der Strafzumessung, 5. Aufl., Rn. 933; aA Theune in LK-StGB, 12. Aufl., § 50 Rn. 15 f.; Horn/Wolters, SK-StGB, 8. Aufl., § 50 Rn. 5; Fischer, StGB, 62. Aufl., § 50 Rn. 5). Der Zweifelssatz findet insofern keine Anwendung.
