Valuation of negative declaratory claims: exclusion of ancillary warning costs from the subject matter in dispute
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant's complaint against the non-admission of revision, rejecting the argument that the appeal’s value exceeded the statutory threshold and consequently fixing the subject matter in dispute at €20,000. The dispute concerned the appropriate calculation of the court fee value (Streitwert) for a negative declaratory action, specifically whether the defendant’s claim for the reimbursement of warning costs (Abmahnkosten) amounting to €859.80 should be included in the valuation. Relying on Section 4 of the Code of Civil Procedure, the court held that such warning costs constitute ancillary claims (Nebenforderungen) that must be excluded from the assessment, determining instead that the value of a negative declaratory action is equivalent to that of a performance claim of the opposite tenor.
