Recidivism mitigation via identification of habitual receivers in serial theft cases
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (5th Criminal Senate) dismissed the defendant's appeal as unfounded, with a minor correction to the conviction to include charges of document forgery in concurrence with fraud, document forgery, and three counts of intentional driving without a license, thereby upholding the lower court's guilty verdict and sentencing. The dispute centered on the defendant's challenge to the sentence imposed for multiple counts of theft, attempted theft, and traffic offenses, specifically regarding the application of recidivism mitigations. The court held that the conditions of § 46b Abs. 1 Satz 1 Nr. 1 StGB were met because the defendant, in accordance with his plan, identified the habitual receivers (fences) to whom he passed the stolen goods, establishing the requisite final connection for sentence mitigation even for offenses committed after August 1, 2013, as intended by the legislative will.

Strafzumessung: Aufklärunghilfe des wegen Diebstahls Angeklagten durch Benennung seines Hehlers
[TENOR]
