Cost allocation after mutual settlement: No reduction of dispute value for attorney fees where cost interest exceeds main case value
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice ordered the defendant to bear the costs of the entire proceedings, effectively allowing the plaintiff to prevail on costs despite the dispute being declared settled by mutual agreement, and fixed the appeal value at €1,200. This decision addressed a procedural cost allocation issue in a civil case where the parties had declared the litigation moot (*Erledigungserklärung*), with the core question being whether the original main case value should be reduced based solely on the post-settlement cost interest. The court relied on § 91a Abs. 1 Satz 1 ZPO in conjunction with the legal consequence of the defendant's acknowledgment of the cost obligation, determining that no time-staggered reduction of the dispute value was warranted because the plaintiff's cost interest exceeded the main case value, thus retaining the original value under § 40 GKG and rejecting a lower valuation for attorney fee purposes.

Kostenentscheidung nach Erledigung: Anerkennung der Kostentragungspflicht durch eine Partei; Streitwertermäßigung
[TENOR]
