Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the appeals of two defendants as unfounded, upholding the conviction by the Darmstadt Regional Court, but corrected the judgment's operative part to explicitly include two prior convictions from 2008 for defendant E. in accordance with established case law. The dispute concerned a juvenile criminal proceeding where the appellate court had failed to list the previously incorporated sentences in the final order when imposing a unified juvenile punishment. The decisive legal basis was the prevailing BGH doctrine requiring that when a prior judgment is folded into a new one, the original incorporated judgment must also be recited in the tenor of the new judgment to ensure formal legal completeness, a procedural error the BGH rectified by amending the text of the decision rather than remanding the case.

Einheitsjugendstrafe: Einbeziehung von Vorverurteilungen

[TENOR]
