The Federal Court of Justice (BGH) dismissed the appeals of the defendants as unfounded, upholding the district court's conviction and ordering each appellant to bear their own costs and those incurred by the civil plaintiff. The case concerned a challenge under German criminal procedure law regarding the admissibility of translated police interrogation records of a witness who is the spouse of one defendant and thus entitled to refuse testimony; the defendants argued that the records were unusable due to a violation of statutory rules on witness rights. The court held that no prohibition on the use of evidence arose under Sections 52 and 252 of the Code of Criminal Procedure because the witness was unreachable at the main trial, the right to refuse testimony did not exist at the time of the initial police interviews (rendering prior instruction unnecessary), and the records were read aloud with the defendants' consent under Section 251(1) No. 1 StPO; furthermore, the evidence was utilized exclusively to create reasonable doubt against the complainant’s more incriminating statements in favor of the defendants, thereby rendering any alleged procedural violation irrelevant to the verdict.
