Cure of denial of legal hearing in criminal appeal rejected for failure to address decision-relevant arguments
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice dismissed the defendant's motion to cure the denial of legal hearing, thereby upholding the Senate's March 19, 2014, decision and leaving the underlying rejection of the defendant's appeal in force. The dispute arose from the defendant's challenge to the Superior Court of Cassation's June 27, 2012, rulings, which had previously been deemed inadmissible because they were not subject to appeal under the applicable procedural rules; the defendant argued that his submissions, including a "counter-statement," had been ignored, violating his right to be heard. Relying on Section 33a of the Code of Criminal Procedure and the principle that a violation of legal hearing requires the ignoring of decision-relevant arguments, the court found no such violation and rejected the motion, as the Senate had not overlooked any material arguments.
