Calculation of suspension deadline for main trial resumption: Exclusion of commencement and resumption dates and weekend adjustments under § 229 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) third Criminal Senate dismissed the defendant's appeal as unfounded, upholding the lower court's conviction and ordering the defendant to bear the legal costs. The dispute centered on whether the prosecution violated procedural law by failing to resume the main hearing on the date originally mandated by a suspension order under § 229 StPO. The court determined that no procedural error occurred because the statutory suspension period had not expired by the time the hearing resumed; specifically, under § 229 StPO, neither the day of suspension nor the day of resumption counts toward the deadline, causing the two-week period to end on a Friday when the next designated resumption day fell on a Saturday. Consequently, pursuant to § 229 Abs. 4 Satz 2 StPO, the hearing was required to resume on the following Monday, which aligned with the actual resumption date, rendering the defendant's procedural objection regarding the missed deadline invalid.
