Liability insurer’s right to deny accident via non-knowledge despite acting as helper in suspected accident manipulation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, leaving the lower court's judgment in force and ordering the plaintiff to bear the costs of the proceedings. The case involved a dispute over liability for a vehicle accident where the plaintiff alleged accident manipulation, challenging the lower court's allowance of the defendant insurer to deny the accident and its course of events through a "lack of knowledge" defense despite the insurer acting simultaneously as a principal and a helper of the insured party. The court held that in cases of suspected accident manipulation, a motor vehicle liability insurer is entitled to deny the claimed accident and its circumstances via "non-knowledge," even when acting as a helper to the insured, thereby affirming that such procedural posture does not preclude this substantive defense under § 543 Abs. 2 S. 1 ZPO.

Kfz-Haftpflichtversicherer als Streitgenosse bzw. Streithelfer beim Verdacht der Unfallmanipulation
[TENOR]
Halbs. ZPO abgesehen.
Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
