Inadmissibility of hearing rights complaint challenging non-binding Federal Court of Justice indications in procurement review proceedings
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the applicant's complaint for lack of a hearing (Gehörsrüge), upholding the validity of the procedural outcome. The dispute arose in a public procurement review proceedings where the applicant challenged a decision regarding the assessment of its suitability, specifically concerning annual revenue references for complex underground and pipeline construction works. The applicant argued that the BGH's prior indications for further proceedings before the superior court violated its right to be heard. The court held the complaint inadmissible under § 71a Abs. 1 and § 120 Abs. 2 of the German Act Against Restraints of Competition (GWB), determining that Abhilfe via Gehörsrüge is available only against final decisions where no further legal remedy exists. Since the previous decision merely provided non-binding guidance for the subsequent instance and did not constitute a final judgment on the merits, the applicant was precluded from using this specific remedy to challenge the procedural handling of its suitability requirements.
