Eviction enforcement stay; value of dispute threshold for non-acceptance complaint
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant's application for a stay of enforcement, leaving the lower court's eviction judgment in full force. In a civil appeal regarding a tenancy dispute, the defendant sought to halt the execution of a first-instance judgment for vacating the premises while contesting the non-acceptance of the appeal. The court determined that the application was unfounded because the appeal was hopeless, and separately ruled the non-acceptance complaint inadmissible because the value in dispute did not exceed the statutory threshold of €20,000 under § 26 Nr. 8 EGZPO. Applying established case law, the court calculated the financial interest in dispute as three and a half times the annual agreed-upon rent, totaling approximately €11,854, thereby rejecting the argument that a higher hypothetical market rent should be used for the valuation.

Zwangsräumung: Einstellung der Zwangsvollstreckung in der Revisionsinstanz; Wert der Beschwer bei Verurteilung zur Räumung
[TENOR]
