Validity of psychiatric detention: Impartiality of expert employed by detention facility and proportionality limits on duration
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's revision as unfounded, upholding the Lower Regional Court of Potsdam's order for placement in a psychiatric hospital within a security measure proceeding, thereby leaving the initial detention order in force. The dispute centered on the validity of the security measure, specifically challenging the impartiality of the appointed expert witness due to their concurrent employment at the clinic where the defendant was provisionally detained and complaints regarding treatment. The court held that the lower court correctly rejected the challenge to the expert's impartiality without error and noted that the duration of the placement must be limited based on the principle of proportionality, as established in the Federal Constitutional Court's case law.
