VOB guarantee: independence of limitation periods for principal and surety claims and extinction of surety claim via deposit
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 11th Civil Senate rejected the plaintiff's complaint against the non-allowance of revision, thereby affirming the lower court's judgment in the plaintiff's favor, while noting that the appellate decision was correct on alternative grounds. The dispute concerned a VOB contract and the interplay between the limitation of the principal claim for warranty performance and the limitation of the guarantee claim, specifically whether the guarantee provider could invoke the limitation of the principal claim under § 768 Abs. 1 BGB and how the purpose of § 17 Nr. 8 VOB/B applies. The Court clarified that while the limitation of the principal claim is generally independent from the limitation of the guarantee claim, the guarantee claim had already extinguished because the guarantor had performed by depositing the amount with the deposit authority pursuant to § 232 BGB, which the parties agreed constituted full performance. Consequently, the creditor could enforce the claim against the deposit authority as a pledge creditor under §§ 1257, 1273, 1279, 1282 Abs. 1 BGB, rendering the limitation of the secured warranty claims under §§ 214, 216, 233 BGB irrelevant.

Februar 2000 - VII ZR 51/98, BGHZ 143, 397, 399).
Von einer weiteren Begründung wird gemäß § 544 Abs. 4 Satz 2 Halbs. 2 ZPO abgesehen.
Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
Der Gegenstandswert des Beschwerdeverfahrens beträgt 25.000 €.
