The defendant’s appeal against the regional court’s conviction was dismissed as unfounded, upholding the original judgment and ordering the defendant to bear the costs of the appellate proceedings and the victim’s necessary expenses. The dispute centered on a criminal law revision where the defendant challenged the validity of the indictment decision, arguing it was issued by an improperly constituted judicial panel. The court held that even assuming a composition error existed, it did not render the indictment decision void; rather, such a defect constitutes only a mere irregularity that cannot be effectively challenged on appeal under the German Code of Criminal Procedure. The decisive legal basis established that errors in the composition of the court at the stage of the indictment decision are subject to the strict limitations of § 336 Sentence 2 and § 210 StPO, thereby excluding them from review in a revision proceeding.

Cited as the legal basis for rejecting the revision as unfounded because the review did not yield a legal error to the defendant's disadvantage.

BGH, Beschluss vom 18. Februar 1981 - 3 StR 269/80, NStZ 1981, 447 m. Anm. Rieß; Meyer-Goßner, StPO, 56. Aufl., § 207 Rn. 11, 14 jeweils mwN).
