Criminal Appeal Dismissal; Judicial Independence of Collegiate Deliberation Methods and Irrelevance of "Four-Eyes Principle" Inquiry
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (3rd Criminal Senate) dismissed the defendant's appeal as unfounded, upholding the conviction by the Wuppertal Regional Court and ordering the defendant to bear the costs of the proceedings and the necessary expenses of the auxiliary plaintiffs. The dispute concerned a criminal prosecution where the defense counsel requested an official confirmation of whether the collegiate judicial body operated under a "two-person rule" (Vier-Augens-Prinzip) for its deliberations. The court ruled that no reason existed to address this inquiry, clarifying that the methods by which judges acquire the factual and legal grounds necessary for a decision fall within the scope of judicial independence, distinct from the constitutional principle of the legally prescribed judge.

Verwerfung der Revision im Strafverfahren bei offensichtlicher Unbegründetheit: "Vier-Augen-Prinzip"
[TENOR]
