Alcohol-induced diminished criminal responsibility: validity of blood alcohol elimination rate calculation in manslaughter prosecution
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's revision as unfounded, upholding the conviction for manslaughter by the Hamburg Regional Court and ordering the defendant to bear the costs of the appellate proceedings. The dispute centered on the legal validity of the lower court's assessment of the defendant's diminished capacity to act due to alcohol intoxication, specifically challenging the application of a purportedly erroneous hourly blood alcohol concentration (BAK) elimination rate. While the appellant argued that the lower court incorrectly applied a "benefit of the doubt" by assuming a 0.2 per mille per hour elimination rate—which the BGH noted would be legally erroneous as the maximum BAK must be established to assess guilt—the court determined that the trial court had in fact correctly calculated the BAK using a standard 0.1 per mille per hour rate, thereby rejecting the claimed legal error and maintaining the original sentence.
