Rejection of witness application due to lack of relevance: No evidence application exists, requiring assessment under ex officio duty to clarify facts
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Justice (BGH) dismissed the defendant's appeal as unfounded, upholding the lower court's conviction and ordering the defendant to bear the costs of the appeal. The dispute centered on the trial court's rejection of a defense witness application, with the defense arguing that the rejection violated procedural rights. The court held that the rejection was legally correct because the proposed evidence lacked necessary relevance (Konnexität) to the charged offenses. Legally, the BGH clarified that a lack of relevance does not render a witness application "inadmissible" under procedural law; rather, it means no formal "evidence application" exists, so the trial court must instead evaluate the request based on its ex officio duty to clarify the facts (Amtsaufklärungspflicht).

(Strafverfahren: Ablehnung eines Beweisantrags wegen fehlender Konnexität)
[TENOR]
November 2010 - 1 StR 497/10, NJW 2011, 1239, 1240 f.; Urteile vom 8. Dezember 1993 - 3 StR 446/93, NJW 1994, 1294 und vom 28. November 1997 - 3 StR 114/97, NJW 1998, 1723, 1725).
