The Federal Court of Justice dismissed the debtor's legal complaint as inadmissible, thereby upholding the lower court's decision to deny discharge of residual debts, and assigned the case a value of €4,000. The dispute concerned whether a debtor was obligated to assign and disclose the value of non-cash benefits, specifically the free provision of a company car, as part of their attachable income from an employment relationship when applying for debt relief. The court held that under § 295(1) no. 3 of the Insolvency Code, the ground for refusal of discharge extends to the concealment of labor income, which includes in-kind benefits treated as monetary income pursuant to § 850e no. 3 of the Code of Civil Procedure; consequently, the value of the car is subject to attachment if the debtor's remaining available amount covers this value. The Court further noted that the debtor's complaint failed to properly demonstrate the contested nature of the legal question under § 574(2) no. 1 ZPO, and the alternative legal basis regarding § 296(2) InsO was deemed not decisive because the rejection was properly grounded in § 295(1) no. 3 InsO.
