Constitutional content control of church labor agreements; non-admission of revision due to established Federal Labor Court jurisprudence
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (4th Civil Senate) dismissed the complainant's non-admission complaint, thereby rejecting the petition for leave to appeal and leaving the judgment of the Higher Regional Court of Hamm in force, with the plaintiff bearing the costs. The dispute concerned the content control of collective labor agreements for church employees, specifically challenging whether certain contractual provisions complied with constitutional standards. The court held that no question of fundamental importance existed, nor did the need for legal development or uniform jurisprudence require a decision by the Supreme Court, as the relevant legal issues were sufficiently clarified by established case law from the Federal Labor Court, which the civil senate adopted.
