Restitutionary claim for returned inheritance assets under § 346 BGB as a relationship surrogate preventing full estate settlement under § 2042 BGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant’s complaint against the non-admission of revision, thereby upholding the decision of the Kammergericht and leaving the lower court’s judgment in force. The dispute centered on the rights of a co-tenancy community following the withdrawal from a contract for the sale of a fractional inheritance interest, specifically regarding the resulting restitutionary claims and the status of the estate settlement. Relying on established case law, the court held that no grounds for revision existed to correct existing legal doctrine, as the withdrawal prevented a complete distribution of estate assets under the relationship surrogate of § 2042 BGB via the restitutionary claim of § 346 BGB, meaning a final settlement of the co-tenancy had not occurred; consequently, the defendant must bear the costs of the proceedings.
