Contracted physician status under criminal law: exclusion from public official corruption offenses due to non-qualification as Amtsträger
Legislator-Zusammenfassung
KI-generiertThe BGH 5th Criminal Senate quashed the lower court's conviction and ordered the unconditional acquittal of both defendants, reversing the prior finding of guilt. The dispute concerned whether a contracted physician constitutes a public official (*Amtsträger*) for the purpose of corruption offenses, specifically arising from an illicit agreement to issue prescriptions for a pharmaceutical company's products in exchange for kickback payments. Relying on a recent decision by the Grand Chamber for Criminal Matters, the court held that such a physician is not a public official under § 11 Abs. 1 Nr. 2 lit. c StGB, rendering the conviction for corruption under § 299 StGB legally impossible; furthermore, the court determined that the underlying illicit agreement could not be recharacterized as other property crimes (e.g., fraud under §§ 263 or 266 StGB) due to differences in protected legal interests and specific factual requirements, necessitating a full acquittal.
