Adhesion claims in criminal proceedings: Guardian's lack of authority and exclusion from adhesion proceedings due to exclusive role of defense counsel
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant’s appeal as unfounded, upholding the lower court’s judgment and ordering the defendant to bear the costs of the proceedings, including specific costs arising from the adhesion proceeding and the adverse party’s necessary expenses. The dispute centered on whether a guardian with the legally mandated scope of authority to assert and defend legal claims could prevent or participate in an adhesion claim in criminal proceedings, specifically challenging a lower court decision rendered without the guardian’s involvement or hearing. The court held that criminal procedure law is distinct from civil procedure law, where guardians act as statutory representatives under the Civil Procedure Code and Civil Code; in criminal cases, the defense of the defendant’s interests rests solely with the mandatory defense counsel, and the procedural rights applicable to guardians in civil matters do not apply or cannot be extended by analogy to criminal adhesion proceedings.

Adhäsionsverfahren: Wahrnehmung der Interessen des Angeklagten durch den Betreuer
[TENOR]
April 2008 - 1 StR 165/08, NStZ 2008, 524; A. Roth in Erman, BGB, 13. Aufl., § 1896 Rn. 72; a. A. Schwab in Münchener Kommentar, BGB, 5. Aufl., § 1896 Rn. 94).
