Scope of trial record under directness principle and prohibition of reconstructing pre-trial witness statements
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (4th Criminal Senate) dismissed the defendant's appeal against the judgment of the Zweibrücken Regional Court of 10 February 2012 as unfounded, ordering the defendant to bear the costs of the appellate proceedings. The dispute concerned the adequacy of the trial court's assessment of evidence, specifically the defendant's argument that the court violated § 261 StPO by failing to address contradictions in witness statements recorded during the pre-trial investigation and ignoring statements made by another witness that were not reflected in the judgment. The court ruled that only testimony given by the officers who conducted the pre-trial interrogations, as heard during the main hearing, forms part of the trial record under the directness principle; consequently, the reliance on written investigation protocols or unaddressed pre-trial statements constituted external evidence (urteilsfremdes Vorbringen) prohibited by the reconstruction ban, rendering the procedural violation claim inadmissible and unjustified.

Revisionsverfahren: Rüge der Nichtberücksichtigung von widersprüchlichen Zeugenaussagen
[TENOR]
