Scope of litigation power of attorney under § 81 ZPO for appointing substitute counsel in non-admission complaint proceedings
Legislator-Zusammenfassung
KI-generiertThe defendant's objection to the cost assessment was dismissed, upholding the levy of 311 € in court fees. The dispute concerned the procedural standing and financial liability for a non-admission complaint against a lower court's refusal to allow revision, which the defendant had withdrawn. The defendant argued it was not the proper party, claiming the insurer was conducting the litigation, and that it had not personally mandated the specific attorney filing the complaint. The court held that the attorney was validly authorized under § 81 ZPO as a substitute counsel for the non-admission complaint procedure based on the general litigation mandate granted for earlier instances, thereby establishing the defendant's liability as the complainant under § 22 Abs. 1 Satz 1 GKG. The key legal basis for the decision rested on §§ 6, 9, 34, and 66 GKG, § 139 GVG, and § 81 ZPO, confirming that the insurer's potential internal reimbursement obligation did not absolve the defendant of its primary procedural liability.

Umfang der Prozessvollmacht: Vertreterbestellung für das Nichtzulassungsbeschwerdeverfahren
[TENOR]
[GRUENDE]
I. Mit Schriftsatz vom 18. Dezember 2011 (Az. 13 U 323/11) eingelegt.
BGH, Beschluss vom 13. Januar 2005 - V ZR 218/04, NJW-RR 2005, 584; BGH, Beschluss vom 17. August 2010 - I ZB 7/10, juris Rn. 2).
III. Die Erinnerung hat keinen Erfolg.
IV. Das Verfahren ist nach § 66 Abs. 8 GKG gebührenfrei. Kosten werden nicht erstattet.
