Territorial jurisdiction for fraud: place of success includes intermediate successes such as victim's mistake and asset disposal at management location
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 1st Criminal Senate dismissed the defendant's revision against the Landgericht Ulm judgment, leaving the conviction in force and ordering the defendant to bear the costs of the legal remedy. The dispute concerned whether the Landgericht Ulm had proper territorial jurisdiction under German criminal procedure for charges of fraud, with the defendant challenging the location of the "place of success" (Erfolgsort) in a cross-border or multi-jurisdictional fraud scheme. The Court held that jurisdiction attaches to intermediate successes inherent to the fraud's constitutive elements, specifically the victim's mistake and the subsequent disposal of assets, and confirmed that Ulm was the valid place of success because the victim’s total assets, including the specific funds transferred, were managed and controlled from Ulm, where the victim maintained all banking relationships and executed the financial disbursement, rendering internal administrative transfers of bank account management to another city irrelevant. The decisive legal basis is § 349 Abs. 2 StPO for the dismissal of the revision and the doctrinal interpretation of the "place of success" in fraud cases under § 9 StGB, which includes intermediate procedural steps like mistake and disposition.

Erfolgsort einer Straftat bei Zwischenerfolgen
[TENOR]
I, Blatt 64; EA Bd. I, Blatt 83). … Ich war nie wegen Bankgeschäften in He. ." Februar 2009 (EA Bd. I, Blatt 72) der hier maßgeblichen 500.000 € (Vermögensverfügung).
