The Federal Court of Justice (4th Criminal Senate) dismissed the defendant's appeal as unfounded, upholding the juvenile criminal conviction for serious robbery with extortion imposed by the Landgericht Halle, while noting that the costs of the appeal would not be imposed on the appellant. The case involved a juvenile offender convicted of serious robbery with extortion, where the defendant challenged the procedural handling of certain counts and the sentencing rationale. The Court held that while the first instance's acquittal on one count due to the absence of a complaint was procedurally incorrect (it should have been a dismissal under § 260 Abs. 3 StPO), the defendant was not aggrieved by this error because a valid complaint actually existed. Furthermore, the Court determined that the trial court's failure to explicitly discuss a "lesser serious case" (§§ 253, 255, 249 Abs. 2 StGB) did not constitute a decisive legal error, as the juvenile sentence was based on the defendant's harmful inclinations and significant developmental deficits rather than the specific classification of the offense.
