Accessories to fraud: requirement of independent commercial intent to apply aggravated sentencing framework
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) quashed the sentencing portion of the Leipzig Regional Court's judgment and remanded the case to a different economic criminal chamber for a new hearing, upholding the original findings of fact. The dispute concerned a defendant convicted of aiding and abetting fraud in three instances, who challenged the imposition of a total prison sentence of three and a half years. The appellate court determined that the lower court erred by applying the enhanced statutory sentencing framework for "commercial" fraud to the accessory without sufficient evidence; specifically, the lower court failed to identify the concrete benefits the defendant derived from the principal's activities, which was necessary to establish that the accessory's conduct independently met the criteria for a particularly serious case. Relying on the doctrine that an accomplice is subject to a statutory aggravation only if their own participation constitutes a particularly serious case, the BGH found this a legal error affecting the sentencing, while confirming that the underlying factual findings remained valid for the remand.
