Admissibility of evidence-taking challenges in criminal revision: sufficiency of factual assertions versus requirement of citing specific file references
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal (BGH) dismissed the appeals of the defendants against the lower court's conviction, ordering each appellant to bear their own costs, thereby upholding the original judgment. The dispute centered on the sufficiency of the revisional grounds, specifically challenging the lower court's failure to conduct evidence-taking regarding whether the victim company had consented to the alleged thefts, and the appellants argued that the lower court had violated its duty to clarify the facts. While the BGH held that the revisions were not inadmissible merely because specific file references for the evidence were not provided (reiterating that such references are not a mandatory requirement for admissibility), the appeals were ultimately rejected as inadmissible because the appellants failed to formulate specific factual assertions or concrete indications demonstrating that the company actually consented to the acts, meaning no further evidence gathering was required under the statutory duty to exonerate.
