Attempted aggravated arson: exclusion of floor skirting boards from essential building parts and justification of preventive detention for mentally ill offender
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice (BGH) dismissed the defendant's appeal as unfounded, thereby upholding the Landgericht Berlin's conviction and the order placing him in a psychiatric hospital. The case involved a challenge to a conviction for attempted aggravated arson, where the defendant, suffering from paranoid-hallucinatory schizophrenia, set fire to a building. Although the appellate court clarified that the lower court's specific finding of completed aggravated arson was legally insufficient because the fire only consumed non-essential parts of the structure (floor skirting boards) and did not cause partial destruction of the building, this error did not affect the final judgment. The BGH held that the factual findings still legally supported a conviction for attempted aggravated arson in concurrence with property damage, and confirmed the defendant's dangerousness justifying the mandatory preventive detention under the provisions for placing mentally ill offenders in psychiatric hospitals.
