The German Federal Court of Civil Procedure (BGH) upheld the lower appellate court's dismissal of the plaintiff's appeal as inadmissible, ruling that the plaintiff’s filing of a "subsequent appeal" (Anerkennungsrevision) was time-barred. The dispute concerned procedural admissibility in a civil case where the defendant had filed an appeal and subsequently provided its grounds for appeal on July 26, 2010, while the plaintiff’s grounds for appeal were not received until October 11, 2010. The court determined that under § 554 Abs. 2 Satz 2 ZPO, the one-month period for filing a subsequent appeal expires upon the service of the opposing party's grounds for appeal and cannot be extended by a prior extension granted for the plaintiff’s original appeal; because the plaintiff filed its grounds after this strict deadline, the subsequent appeal was procedurally invalid. The court ordered the plaintiff to bear one-fifth of the procedural costs, with the defendant bearing the remaining four-fifths.

Unzulässige Revision: Umdeutung in eine Anschlussrevision

[TENOR]
