Heating cost accounting: Inadmissibility of the outflow principle under the Heating Costs Regulation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure (BGH) intended to dismiss the tenant's appeal as unfounded by unanimous order, a decision that was finalized on April 17, 2012, resulting in the landlord's victory. The dispute concerned the validity of a heating cost settlement in which the landlord had applied the "outflow principle," charging the tenants for fuel purchased at the end of the billing period rather than fuel actually consumed during that period. The Court determined that the outflow principle is inadmissible in the context of the Heating Costs Regulation, as § 7 Abs. 2 HeizkostenV mandates the allocation of costs for fuel consumed within the accounting period. Furthermore, the Court held that the specific contractual practices or alleged silent agreement between the parties could not override the statutory provisions of § 2 HeizkostenV, which take precedence over legal transactions, and that the exception for buildings with two or fewer units where one is owner-occupied did not apply.

Heizkostenabrechnung: Anwendbarkeit des Abflussprinzips
[TENOR]
