Aggravated bodily injury: Effect of victim provocation on sentencing framework selection despite aggravating factors
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice rejected the defendant's revision as unfounded, upholding the Berlin Regional Court's conviction and sentence of four years' imprisonment for dangerous bodily injury. The dispute centered on whether the defendant's actions, which the lower court partially classified as an aborted attempt to commit homicide (benefiting the defendant via exemption from punishment for withdrawal), should instead be qualified under the standard sentencing framework for dangerous bodily injury. The appellate court held that although the victim's provocation suggested a lesser degree of culpability under § 224 para. 1 sentence 2 StGB, the defendant's serious prior criminal record and the specific manner of execution constituted grave aggravating circumstances that mandated the application of the normal sentencing range in § 224 para. 1 StGB rather than the lesser framework; consequently, the lower court's inconsistent choice of the reduced sentencing range for the homicide attempt did not constitute a legal error to the defendant's detriment, as the resulting sentence remained within the correct statutory bounds.
