Tenancy: Persistence of contractual ban on ordinary termination after cooperative dissolution and transfer of ownership
Legislator-Zusammenfassung
KI-generiertThe BGH 8th Civil Senate intends to dismiss the plaintiff's admitted appeal by unanimous decision under § 552a ZPO, leaving the lower court's judgment in force against the tenant. The dispute concerned residential tenancy law, specifically whether a purchaser of a cooperative apartment remained bound by the contractual exclusion of ordinary termination when the tenant's cooperative membership had lapsed due to the cooperative's insolvency. The court determined that the question lacks fundamental significance because the tenant's original membership in the cooperative is irrelevant to the tenancy relationship after the apartment is sold and the purchaser enters the lease. Furthermore, the appeal lacked prospects of success because the appellate court’s reasoning was correct. The decisive legal basis is § 552a ZPO, governing the dismissal of appeals lacking legal importance or prospect of success.
