Legislator-Zusammenfassung

The Federal Court of Justice rejected the notary's application to admit an appeal, thereby upholding the lower court's disciplinary decision and leaving the censure of the notary in force. The dispute concerned a disciplinary complaint alleging that the notary violated professional duties by retrieving land register extracts for six different real estate brokers via the unrestricted automated access procedure, without first verifying that the brokers had valid power of attorney from the respective property owners, despite the notary not having performed any notarization in these cases. The court held that the appeal did not meet the threshold for admission, finding no serious doubts regarding the lower court's correct application of Section 14(1) and (3) of the German Notary Law (BNotO) and no questions of fundamental legal significance regarding the alleged unconstitutionality of those provisions or the permissible scope of automated access.

Berufspflichtverletzung eines Notars: Vermittlung der Grundbucheinsicht für Makler ohne Prüfung der Bevollmächtigung

[TENOR]

3. Die Kostenentscheidung beruht auf § 96 Abs. 1 Satz 1 BNotO, §§ 3, 77 Abs. 1 BDG, § 154 Abs. 2 VwGO; die Wertfestsetzung ist gemäß § 111g Abs. 1 Satz 1 BNotO i.V.m. § 52 Abs. 2 GKG erfolgt.
