The German Federal Court of Criminal Justice (BGH) dismissed the defendant’s appeal as unfounded, upholding the lower court’s order for mandatory commitment to a psychiatric hospital under § 63 StGB. The dispute concerned the legal qualification of the defendant’s diminished culpability and the appropriate security measures following a conviction, with the appellate court confirming that the record sufficiently established a significant reduction in culpability despite ambiguous lower court statements. While affirming the commitment, the BGH issued a supplementary directive requiring the correctional facility to prioritize therapeutic and social stabilization measures, specifically mandating a permanent separation from the defendant’s wife and the utilization or expansion of existing care arrangements to mitigate the specific risk posed to that individual. The decisive legal basis includes § 63 StGB for the commitment due to diminished culpability, and §§ 57, 67d, and 67e StGB, which govern the execution of security measures and the criteria for their review and potential release.
