Insolvency proceedings: Statuta of Rechtsbeschwerde requires prior admission under post-2011 amendment to § 7 InsO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) denied the debtor’s application for legal aid to file a legal appeal (Rechtsbeschwerde), ruling that the intended appeal was not admissible and thus devoid of prospects of success. The dispute concerned the availability of a legal appeal against a decision by the regional court in an insolvency initiation proceeding, specifically whether such an appeal could be filed automatically without prior authorization. The court held that under the amended Insolvency Act effective October 27, 2011, which repealed the previous automatic admissibility provision, a legal appeal is only permissible if expressly permitted by the appellate court; consequently, the lower court’s failure to grant this permission rendered the appeal statutable only if such permission had been granted. The BGH applied the new legal regime pursuant to transitional provisions because the challenged appellate decision was issued after the enactment date, thereby upholding the lower court’s rejection of the appeal's prerequisites and confirming that no further judicial remedy was available for the debtor without prior judicial permission.
