Inadmissibility of appeal in supplementary guardianship appointment lacking mandatory leave under § 70(3)(1)(1) FamFG
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the legal appeal (Rechtsbeschwerde) for non-compliance with admissibility requirements, leaving the lower court’s decision in force. The dispute concerned a petition to appoint a supplementary guardian (Ergänzungsbetreuer) to complement an existing guardian for a person under legal guardianship. The appellate court’s decision refusing the appeal was challenged on the basis that it had not explicitly granted leave for appeal. The BGH held that the appeal was inadmissible because the appointment of a supplementary guardian under §§ 1899(4), 1908i(1), and 1795(1), 1796 of the German Civil Code (BGB) does not fall within the exception under § 70(3)(1)(1) of the Code of Civil Procedure in Family Matters (FamFG), which permits appeals without leave for certain guardianship decisions. Consequently, the absence of leave by the appellate court rendered the appeal procedurally defective, and the lower court’s order stands.

[TENOR]
Die Rechtsbeschwerde gegen den Beschluss der 5. Zivilkammer des Landgerichts Bremen vom 16. November 2010 wird zurückgewiesen.
Das Verfahren der Rechtsbeschwerde ist gerichtsgebührenfrei (§ 131 Abs. 5 Satz 2 KostO).
Beschwerdewert: 3.000 € (§ 23 Abs. 1 Satz 2 RVG iVm § 42 Abs. 3 FamGKG)
[GRUENDE]
