Plea Bargain in Aggravated Robbery: Permissibility of Conditioning Sentence on Gestündnis
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the revisions of the defendants as unfounded, upholding the conviction by the Berlin Regional Court and ordering each defendant to bear the costs of their legal appeal. The dispute concerned a trial for aggravated robbery where the defendants challenged the court's application of a plea bargain agreement under § 257c StPO, arguing that the presiding judge had impermissibly threatened to invoke a sentencing bracket under § 250 para. 3 StGB unless the defendants confessed. The court held that such pressure was not arbitrary and did not constitute an unlawful threat, as the enhanced statutory sentencing framework could only be triggered if a confession established the requisite elements; consequently, the challenge based on a violation of the plea bargain agreement failed, and other claims of undue pressure were deemed insufficiently argued or unproven.

Verständigung im Strafverfahren wegen schweren Raubes: Drohung mit "Sanktionsschere"
[TENOR]
