Provisional stay of enforcement in non-admission complaint proceedings: requirement of prior protective motion and irreparable injury threshold.
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the defendant's motion for a provisional stay of enforcement, leaving the judgment of the Oberlandesgericht Hamm in full force and effect. The dispute arose in the context of a non-admission complaint against an appeal court judgment that had dismissed the defendant's counterclaim and awarded costs to the plaintiff, with the defendant arguing that enforcement—including the threat of a sworn declaration of assets—would destroy his professional existence and constitute an irreparable injury. The court denied the stay, holding that under Section 719(2) of the Code of Civil Procedure (ZPO), which is applied mutatis mutandis via Section 544(5) ZPO for non-admission complaints, a stay is an ultima ratio remedy unavailable if the debtor failed to file a protective motion under Section 712 ZPO in the appeal proceedings when such a filing was possible and reasonable. The court determined that the defendant had not demonstrated that filing a Section 712 ZPO motion in the prior instance was objectively impossible or unreasonable, noting that the risk of losing on the counterclaim and incurring costs was a standard procedural hazard that the debtor should have mitigated through earlier protective measures.
