The BGH 1st Civil Senate dismissed the defendant's counter-plea regarding the dispute value determination in a decision dated July 21, 2011, thereby upholding the previously established amount for the non-admission appeal and the corresponding revision complaint. The dispute concerned a request for justification of the dispute value fixed in a May 19, 2011, senate order, which the court reclassified as a counter-plea against the valuation of the non-admission complaint. The court held that it was correct to base the dispute value on the undisturbed first-instance assessment, calculating the amount based on the defendant’s partial defeat of 57.5% (€14,375) in the appellate proceedings rather than the full claim of €25,000, and determined that a sworn affidavit regarding a competitive prohibition did not sufficiently demonstrate that the actual burden on the defendant exceeded this calculated threshold. The decisive legal basis is the procedural rule governing the determination of dispute value in non-admission appeal proceedings, specifically the principle that the value is derived from the extent of the party’s successful challenge in the prior instance, subject to proof that the actual legal interest or burden justifies a higher valuation.

Gegenvorstellung: Bitte um Begründung der Streitwertfestsetzung

[TENOR]
