Threshold value for admission of revision in managing director removal disputes
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice rejected the defendant's complaint against the non-admission of revision, ruling that the appeal was unsubstantiated because the monetary value of the dispute (Beschwer) did not exceed the statutory threshold of €20,000. The dispute concerned a lawsuit challenging the removal of the defendant from the position of managing director of a limited liability company. The court held that the value at stake is determined by the market value of the shareholder's equity interest in the company, capped by the value of their shares, rather than the managing director's salary or the value of specific corporate transactions. Since the company possessed only statutory share capital and had generated no profits, the value of the defendant's 35% stake was not proven to exceed €20,000. Consequently, the complaint was dismissed on both the ground of insufficient value and the absence of any statutory grounds for revising the lower court's judgment.

Halbsatz ZPO abgesehen.
