The Federal Court of Justice (BGH) dismissed the defendant's application for legal aid to file an objection regarding a hearing violation, ruling that the defendant did not prevail. The dispute concerned the absence of a reasoned decision by the appellate senate when it previously denied legal aid for a non-admission complaint against an OLG Munich judgment. The court held that the prior decision denying legal aid for the non-admission complaint was final and unappealable under § 127(2) and § 567 ZPO. Consequently, because decisions on such applications are unappealable, they do not require a detailed justification, and the lack of reasoning did not constitute a violation of the right to be heard. The court further reasoned that a detailed explanation would not have contributed to clarifying the prerequisites for admitting a revision under § 544(4)(2) ZPO, and the right to a justification cannot be forced through the procedural mechanism of a hearing violation objection.

Prozesskostenhilfe: Anfechtbarkeit der Versagung von Prozesskostenhilfe für eine Nichtzulassungsbeschwerde

[TENOR]

Juni 2009 - II ZA 9/08, Rn. 1, juris; Beschluss vom 25. April 2006 - IV ZA 23/05, Rn. 1, juris).
