Start of limitation period for tax evasion by omission: completion of failure to file VAT return
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 1st Criminal Senate dismissed the defendant’s appeal, upholding the conviction for tax evasion and ordering him to bear the costs of the proceedings. The case involved a dispute over the statutory limitation period for a tax evasion offense committed by omission, specifically the failure to file an annual value-added tax (VAT) return for the 2000 tax year, which the defendant argued had already expired by May 31, 2006. The court held that the offense of tax evasion by non-filing under § 370(1) No. 2 of the Fiscal Code (AO) was not completed until the submission deadline fully elapsed at the end of the final day, rather than during the last day. Consequently, relying on the legal principle that the statute of limitations begins upon the completion of the act (§ 78a German Criminal Code), the court determined that the offense concluded on June 1, 2001, meaning the five-year prosecution limitation period could only expire at the earliest on May 31, 2006, thereby rejecting the argument that the case was time-barred.

BGH, Urteil vom 2. Dezember 2008 - 1 StR 344/08, Rn. 15, wistra 2009, 189, 190; BGH, Beschluss vom 19. Januar 2011 - 1 StR 640/10, Rn. 6; BGH, Urteil vom 11. Dezember 1990 - 5 StR 519/90, BGHR StGB § 78a Satz 1 Umsatzsteuerhinterziehung 2; Jäger in Klein, AO, 10. Aufl., § 370 Rn. 105).
