Unfair competition: Competitiveness of private gambling advertising during the constitutional transition period prior to the Interstate Gambling Agreement
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the appellants' complaint for leave to appeal, leaving the lower court's judgment in favor of the defendants in force and ordering the appellants to bear the costs. The dispute concerned an unfair competition claim challenging band advertising for sports betting, lotteries, and casino games by private providers during the transitional period between the Federal Constitutional Court's 2006 gambling decision and the entry into force of the Interstate Gambling Agreement on January 1, 2008. Relying on its subsequent case law, the court held that the offer of such private gambling services was not competition-law violating during that specific transitional period, thereby establishing that the challenged advertising activity on the relevant match date was legally permissible.

BGH, Urteil vom 18. November 2010 - I ZR 156/07 Rn. 34 ff., juris).
Halbs. ZPO abgesehen.
Die Klägerinnen tragen die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
