The Federal Court of Justice (4th Criminal Senate) rejected the defendants' appeals as unfounded but ordered partial corrections to the guilty verdicts without altering the acquittal aspects of the original judgment, finding the appeals meritless regarding the final conviction outcomes while correcting legal classifications. The dispute involved a criminal prosecution for robbery and extortion, where the defendants were convicted of violent crimes involving the use of a warning pistol, scissors, and a knife to steal property from victims, with the primary challenge being the correct legal categorization of the offenses and their concurrence. Deciding on the distinction between robbery (§ 249 StGB) and robberious extortion (§ 251 StGB), the court applied the doctrine that the external appearance of the victim's property-damaging conduct is decisive, reclassifying one act as aggravated robbery rather than extortion because the accomplice physically took the money, and classifying another as robbery in necessary connection with extortion where physical force was used to extract a necklace before the use of tools; the court also mandated the use of the specific statutory terminology "especially aggravated robbery" to reflect the qualification under § 250 Abs. 2 Nr. 1 StGB.

Abgrenzung von Raub und räuberischer Erpressung; Konkurrenzen

[TENOR]

a) der Angeklagte Jan B.

Januar 1999 - 4 StR 663/98, BGHR StGB § 255 Konkurrenzen 4; Beschluss vom 27. April 1993 - 4 StR 149/93, BGHR StGB § 255 Konkurrenzen 3; vgl. auch Beschluss vom 13. Oktober 2005 - 5 StR 366/05, NStZ 2006, 38).

BGH, Beschluss vom 3. September 2009 - 3 StR 297/09, NStZ 2010, 101 m.w.N.).
