Legal aid denial where tenant’s rent-reduction defense relies on court protocol lacking public document status
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure dismissed the defendant tenant’s application for legal aid, thereby upholding the lessor’s claim and denying the tenant’s access to subsidized litigation. The dispute centered on a rental tenant’s attempt to offset arrears by asserting claims for rent reduction based on alleged property defects, supported by a court protocol submitted as evidence. The court determined that the intended defense lacked sufficient prospects of success because the cited court protocol did not possess the evidentiary status of a public document under § 418 ZPO. This was because the protocol lacked the formal approval required by §§ 160(3) no. 5 and 162(1) ZPO to be considered an official public record, rendering it unsuitable for documentary proof of the alleged defects and thus justifying the rejection of legal aid under § 114 ZPO.

Juli 2007 - XII ZB 14/07, NJW-RR 2007, 1451 Rn. 8; Musielak/Stadler, ZPO, 7. Aufl., § 162 Rn. 5; Zöller/Stöber, ZPO, 28. Aufl., § 162 Rn. 6).
