Liability basis for injury in forced treatment at municipal clinic: sovereign character of involuntary care under state law
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the judgment of the Naumburg Higher Regional Court and leaving the lower court's decision in force. The dispute centered on the applicable basis of liability for a patient injured while undergoing forced medical treatment in the closed ward of a municipal hospital, specifically challenging whether such care constituted a sovereign act triggering state liability. The court ruled that involuntary treatment mandated by state law is considered a sovereign act (Hoheitshandeln) even when performed in a municipal clinic, thereby establishing the legal basis for official liability under Section 839(1) Sentence 2 of the German Civil Code in conjunction with Article 34 of the Basic Law.

[TENOR]
Halbs. ZPO abgesehen.
