The German Federal Court of Justice (BGH) dismissed the revision appeals filed by the defendant and the third-party counterclaimant, leaving the judgment of the Schleswig-Holstein Higher Regional Court of 9 December 2008 in force, and ordered the appellants to bear the costs of both the non-admission complaint and the non-admission proceedings. The dispute, concerning a civil monetary claim with a disputed value of €183,666, involved a challenge to the lower court's decision on the merits and costs. The court found that the appellant's claim of settlement did not constitute a resolving event for either the main action or the revision proceedings, applying § 552a ZPO in conjunction with § 522 Abs. 2 Satz 2 and 3 ZPO for the dismissal and § 97 ZPO for the cost allocation.

Dezember 2008 wird nach § 552 a ZPO i.V.m. § 522 Abs. 2 Satz 2 und 3 ZPO auf Kosten des Beklagten und der Drittwiderklägerin zurückgewiesen.
